LIABILITY

1. The captain of the ship shall be liable for the accuracy of all information concerning the waste, its type, amount, composition and collection time, as well as for any damage due to own equipment defect or faulty operation of own equipment on delivery of the waste.

2. The ship shall be liable for any claim, and compensation costs, that may occur as a consequence of the captain's inaccurate information.

3. Port of Gdynia Authority S.A shall be liable for direct damage to the ship that may occur in connection with receipt of waste if the operator of the ship proves that the damage is the fault of Port of Gdynia Authority S.A. or any party which the latter represents.

4. Port of Gdynia Authority S.A shall not be liable for any damage or losses that may occur in connection with any extraordinary reasons.

5. Any dispute concerning the interpretation of these regulations shall be settled under Polish law by the General Court, appropriate to the location of the Port.
